Terms of Service

These Terms of Service (these “Terms”) set forth the conditions for use of the golf personality assessment service “Golf Profiler” (the “Service”) provided by the Golf Profiler Operations Office(“we,” “us,” or “our”). All persons who use the Service (“you” or “users”) shall use the Service upon agreeing to these Terms.

Article 1 (Scope)

These Terms apply to all relationships between you and us concerning your use of the Service. Any rules, guidelines, or other provisions that we separately establish on the Service constitute part of these Terms; in the event of any conflict between these Terms and such separate provisions, the separate provisions shall prevail.

Article 2 (Definitions)

  • “Assessment” means the feature provided by the Service that classifies your golf-related personality into one of 16 types based on your answers to a set of 32 questions.
  • “Assessment Results” means your answers, the type into which you are classified, and any other information displayed by the Service.
  • “Registered User” means a user who has completed registration pursuant to Article 3.
  • “Guest Use” means use of the Assessment without completing registration.

Article 3 (Registration and Accounts)

  • Registration for the Service is completed when you submit your email address and open the login link (magic link) that we send to you. The Service does not use passwords.
  • An account is automatically created for you the first time you log in. You may set and change your nickname on your My Page after logging in.
  • If you are a minor, you must obtain the consent of a parent or other legal guardian before using the Service. If any information provided at registration is found to be untrue, we may cancel your registration.
  • We may decline to approve a registration if the applicant has already completed registration, if the registration details contain falsehoods, errors, or omissions, or if we otherwise determine that the registration is not appropriate.

Article 4 (Account Management)

  • You are responsible for appropriately managing the email address used for login and the environment in which you receive email.
  • The Service uses cookies and similar technologies to keep you logged in and for other purposes. The handling of cookies is set forth in the Privacy Policy.
  • You bear responsibility for any damage arising from inadequate management of your email address or its use by a third party, and we accept no liability whatsoever for such damage.

Article 5 (Nature of the Service; Status of Assessment Results)

  • The Assessment Results provided by the Service are offered as entertainment and as a reference for self-analysis in enjoying golf, and we do not guarantee their accuracy, completeness, usefulness, or fitness for any particular purpose.
  • The Assessment Results do not constitute medical, psychological, professional, investment, or any other expert advice or evaluation. You shall use the Assessment Results at your own judgment and responsibility.

Article 6 (Guest Use)

  • Where we permit, you may use the Assessment without completing registration. In such cases, we may store a temporary identifier (cookie) in your browser so that your Assessment Results can be displayed again later.
  • Assessment Results created through Guest Use may become unavailable for re-display upon expiration of the relevant cookie or deletion of your browser data. By logging in, you can transfer Assessment Results created during Guest Use to your account.

Article 7 (Intellectual Property Rights)

All copyrights and other intellectual property rights in the Service and in the questions, type classifications, explanatory texts, articles (Tips), logos, designs, and all other content provided through the Service belong to us or to the rightful owners thereof. You may not reproduce, republish, modify, or distribute any of the foregoing beyond the scope of private use without our permission.

Article 8 (Sharing of Assessment Results)

You may freely share your own Assessment Results on social media and other platforms. Any such sharing shall be conducted at your own responsibility and in accordance with the terms of service of the relevant platform. We accept no liability for any disputes or other issues arising from such sharing.

Article 9 (Prohibited Conduct)

In using the Service, you must not engage in any of the following conduct:

  • Conduct that violates laws or regulations or public order and morals;
  • Conduct related to criminal activity;
  • Conduct that infringes the rights or interests of us, other users, or third parties;
  • Conduct that interferes with, or may interfere with, the operation of the Service;
  • Unauthorized access or attempts thereat, or excessive access by automated means (such as scraping);
  • Impersonating another person or registering false information;
  • Using the Service for commercial purposes by any method not authorized by us; and
  • Any other conduct that we reasonably determine to be inappropriate.

Article 10 (Suspension of the Service)

We may suspend or interrupt the provision of all or part of the Service without prior notice to users in the event of system maintenance, inspection, or updates; force majeure such as earthquakes, power outages, or other natural disasters; failures of communication lines, computers, or other equipment; or in any other case where we determine it necessary. We accept no liability for any disadvantage or damage incurred by users or third parties as a result thereof.

Article 11 (Restriction of Use; Deregistration)

If you breach these Terms, or in any other case where we determine it necessary, we may restrict your use of the Service or delete your registration without prior notice. We accept no liability for any damage incurred by you as a result thereof.

Article 12 (Withdrawal)

  • You may request withdrawal from the Service (deletion of your account) at any time by the prescribed method.
  • Even after withdrawal, we may retain your Assessment answers and similar data in a form processed so that no individual can be identified, for the purposes of complying with legal obligations, preventing fraudulent use, and statistical analysis. If you wish to request deletion of your personal data, please submit your request to the contact point set forth in the Privacy Policy.

Article 13 (Disclaimer of Warranties; Limitation of Liability)

  • We make no warranty, express or implied, that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, as well as errors, bugs, and infringements of rights).
  • We accept no liability for any damage incurred by you arising from the Service, except in cases of our willful misconduct or gross negligence. Even where the Consumer Contract Act of Japan or other mandatory laws apply, our liability shall be limited to direct and actual damages ordinarily arising, and we shall not be liable for damages arising from special circumstances.

Article 14 (Changes to the Service)

We may change the content of the Service or terminate the provision of the Service without prior notice to users. We accept no liability for any damage incurred by you as a result thereof.

Article 15 (Amendment of These Terms)

We may amend these Terms without individual notice to users when we determine it necessary. The amended Terms shall take effect when displayed on the Service, and your use of the Service after such amendment shall be deemed acceptance of the amended Terms.

Article 16 (Handling of Personal Information)

We handle personal information obtained through your use of the Service appropriately and in accordance with our Privacy Policy.

Article 17 (Notices and Communications)

Communications from users to us regarding the Service shall be made through the contact form designated by us.

Article 18 (No Assignment of Rights or Obligations)

You may not assign to any third party, or offer as security, your contractual position under these Terms or any rights or obligations under these Terms without our prior written consent.

Article 19 (Governing Law; Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising between you and us in connection with the Service shall be subject to the exclusive agreed-upon jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance, depending on the amount in dispute.

Article 20 (Governing Language)

This English version of these Terms is provided as a reference translation of the Japanese original. In the event of any discrepancy or inconsistency between the Japanese version and this English version, the Japanese version shall prevail.
